These Terms of Service (the “Terms”) govern your access to and use of the Dune & Harbor website, online store, and related services (collectively, the “Services”). By visiting the site, creating an account, or placing an order, you agree to these Terms and to any policies incorporated by reference, including our Privacy Policy, Refund Policy, and Shipping & Returns information.

Dune & Harbor’s online store is hosted by Shopify, which provides the ecommerce platform that allows us to offer products and Services to you.

1. Eligibility and Acceptable Use

You may use the Services only for lawful purposes and in accordance with these Terms. By using the Services, you represent that you are legally capable of entering into a binding agreement in your jurisdiction or that you are using the Services with the permission of a parent or legal guardian where required.

You may not use the Services to violate any law; infringe intellectual-property or privacy rights; transmit malicious code; interfere with the security or operation of the site; scrape, copy, or exploit the Services in an unauthorized manner; submit false or misleading information; or engage in fraudulent, abusive, or harmful conduct.

2. Products and Product Information

We make reasonable efforts to present product descriptions, dimensions, materials, colors, images, and other details accurately. However, displays and photography can vary, and natural, handmade, woven, wood, stone, ceramic, linen, or similarly crafted goods may have normal variations in color, texture, finish, size, or pattern. Such variations are not necessarily defects.

We may update, discontinue, limit, or change products at any time. Product availability is not guaranteed until an order is accepted and fulfilled.

3. Prices, Taxes, and Payments

Prices are shown in the currency indicated on the site and may change without notice. Applicable taxes, shipping charges, duties, or other fees will be shown at checkout when available. You agree to provide current, complete, and accurate payment and billing information.

If a product is listed at an incorrect price because of a typographical, technical, supplier, or other error, we may correct the error and, where permitted, cancel or contact you regarding the affected order. Any refund owed for a canceled order will be returned to the original payment method.

4. Orders and Order Acceptance

Your submission of an order is an offer to purchase. We reserve the right, to the extent permitted by law, to accept, decline, limit, or cancel an order, including because of inventory problems, pricing or listing errors, suspected fraud, payment authorization issues, shipping restrictions, or other operational reasons.

We may limit quantities purchased per person, household, account, payment method, or order when reasonably necessary. If we cancel an order after payment has been captured, we will issue an appropriate refund.

5. Fulfillment, Shipping, and Delivery

Some Dune & Harbor items are fulfilled by third-party partners and may ship separately from different locations. Processing and delivery estimates are provided in good faith but are not guarantees. Please review our Shipping & Returns page for additional information about processing, tracking, address accuracy, split shipments, delays, and damaged or missing packages.

6. Returns and Refunds

Returns, refunds, damaged-item claims, and exchanges are governed by our Refund Policy. Please review that policy before making a purchase. Nothing in these Terms limits rights that cannot legally be waived.

7. Accounts

If account features are available, you are responsible for maintaining the confidentiality of your login credentials and for activity that occurs through your account. Please notify us promptly if you believe your account has been accessed without authorization.

8. Intellectual Property

The Dune & Harbor name, branding, site design, original text, graphics, logos, photographs, collection names, and other content owned by us are protected by applicable intellectual-property laws. Except as expressly permitted, you may not reproduce, distribute, modify, create derivative works from, commercially exploit, or use our proprietary content without prior written permission.

Product names, trademarks, photographs, and other materials supplied by third-party brands or partners remain the property of their respective owners.

9. Reviews, Feedback, and User Content

If you submit a review, photo, comment, suggestion, or other content to us, you represent that you have the right to provide it and that it does not violate the rights of another person or any law. You grant Dune & Harbor a non-exclusive, worldwide, royalty-free license to use, reproduce, display, and adapt that content for operating, improving, and promoting the Services, subject to applicable law and our Privacy Policy.

We may moderate or remove user content that is unlawful, abusive, misleading, infringing, or otherwise inappropriate.

10. Third-Party Services and Links

The Services may rely on or link to third-party platforms, payment processors, carriers, fulfillment providers, social networks, or websites. We are not responsible for third-party content, policies, availability, or services except to the extent responsibility cannot be excluded by law. Your use of third-party services may be subject to separate terms and privacy policies.

Our collection and use of personal information is described in our Privacy Policy. By using the Services, you acknowledge that information may be processed by Shopify and other service providers as described in that policy.

12. Disclaimer of Warranties

To the fullest extent permitted by applicable law, the Services and website content are provided on an “as is” and “as available” basis. We do not warrant that the website will always be uninterrupted, error-free, secure, or free from harmful components. Product warranties, if any, may be provided by the applicable manufacturer or supplier.

Some jurisdictions do not allow certain warranty exclusions, so portions of this section may not apply to you.

13. Limitation of Liability

To the fullest extent permitted by law, Dune & Harbor and its owners, employees, affiliates, service providers, and partners will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from use of the Services or products, including lost profits, lost data, or loss of goodwill, where such damages may lawfully be excluded.

Where liability cannot be excluded, our liability will be limited only to the extent permitted by applicable law. Nothing in these Terms excludes liability that cannot legally be limited or excluded.

14. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Dune & Harbor and its service providers from third-party claims, liabilities, damages, and reasonable costs arising from your unlawful misuse of the Services, your violation of these Terms, or your infringement of another person’s rights.

15. Changes to the Services or Terms

We may update the Services and these Terms from time to time. Updated Terms will be posted on this page with a revised “Last updated” date. Changes apply prospectively unless applicable law requires otherwise. Your continued use of the Services after an update constitutes acceptance of the revised Terms to the extent permitted by law.

16. Severability and No Waiver

If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect to the extent permitted by law. Our failure to enforce a provision does not waive our right to enforce it later.

These Terms are governed by the laws applicable to Dune & Harbor’s business and your transaction, without limiting any mandatory consumer rights or protections that apply based on your place of residence.
